1. Commencement and Termination
This Agreement shall come into force upon your acceptance as a Client of DrivingLicences.es and shall remain in effect until terminated.
The Client is entitled to terminate this Agreement with immediate effect at any time. The refund policy only covers the first 14 days after you have signed up for the service.
DrivingLicences.es is entitled to terminate this Agreement and suspend Clients from the DrivingLicences.es service at any time, giving reasonable notice where possible.
2. Payment
Clients will make payments to DrivingLicences.es online before we deliver the service.
Once payment has been made, the Client has 14 days to request a refund. The Client doesn’t have to give a reason, but it would be helpful for the service if you can tell us why you are requesting a refund.
DrivingLicences.es, when requested at any point during the first 14 days, will issue a refund in full. It will be the responsibility of our payment provider Stripe to ensure it returns payment to the Client, taking no longer than 21 working days in most cases.
After 14 days have passed, the Client can no longer ask for a refund in full.
The Client, if after signing up to the service, doesn’t use the service entirely and has not asked for a refund inside the first 14 days, then they forfeit all rights to a refund.
3. Clients Duty
The Client understands that they are using DrivingLicences.es to help with booking appointments with DGT, to obtain instructions on how to do the full process and for completing all the forms needed for the Client to exchange their valid driving licence for a Spanish one.
The Client will upload copies of original and valid documents, so we can perform the job they have asked us to carry out. Documents are required for appointments, must be original and valid, and are not incorrect or not acceptable. We carry no responsibility if the Client doesn’t follow our guidance on what they need to bring with them as detailed.
The Client understands that if changes occur by authorities that require us to cancel or rebook, DrivingLicences.es won’t be held responsible because of 3rd party actions. DrivingLicences.es do not offer discounts to Clients if they or we have to return to the same appointment due to circumstances outside of our control.
Clients shall attend appointments they have requested, and if a client cannot attend an appointment, they may be subject to a ban from our service or asked to pay in full again before we undertake any more work on behalf of the Client.
Non-attendance or last-minute cancellations by the Client can incur an additional cost to rebook the Client; this is set at €10+IVA.
The Client understands that we make no guarantee of when an appointment will be booked, we will try our best to accommodate any requests you give, but this is often not possible as DGT will issue the next appointment they have and this can range from 24 hours notice to several months in advance.
We will post notice of any DGT offices that are having appointment shortages on our website, do not sign up if you need to go to an office in these areas as it will be a much longer wait before you get an appointment.
The amount we charge is for the process, not the result. Results can never be guaranteed by anyone (the Spanish Government ultimately decides).
For UK clients only, we do not guarantee you will get an appointment before the end of the 2020 transition period.
4. Indemnification
The Client shall keep DrivingLicences.es indemnified against any claims for damages or other claims for compensation arising from the use of the DrivingLicences.es service or any incorrect information given to DrivingLicences.es by the Client.
5. Liability Limits
COSTA INSIDER SL TOTAL LIABILITY TO THE CLIENT INCLUDING IN CONTRACT AND TORT (INCLUDING THE TORT OF NEGLIGENCE) SHALL NOT EXCEED 5 TIMES THE FEES OR 200,00 € (TWO HUNDRED EUROS) WHATEVER IS LESSER.
6. Client Information
The Client consents to DrivingLicences.es being given access to private and confidential information about the Client while performing tasks for the Client.
DrivingLicences.es may contact the Client by email, text message, telephone or post for feedback relating to the service, including any ways in which we may improve the service.
7. Applicable Law
This Agreement is subject to the laws of Spain and shall be subject to the non-exclusive jurisdiction of the Spanish courts.
If any dispute arises out of this Agreement, the Parties will attempt to settle it by a mediation procedure as the parties may agree in writing.
